Contest Rules
By submitting an entry to the BO.LT "Public Everywhere and Anywhere" Sweepstakes (the "Sweepstakes"), you acknowledge that you have read and agree to be bound by these Official Rules and the decisions of Boltnet Inc., and that you satisfy all eligibility requirements. BO.LT "Public Anywhere and Everywhere" Online Contest - Official Rules NO PURCHASE NECESSARY. NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES. A PURCHASE WILL NOT AFFECT OR IMPROVE THE CHANCES OF WINNING. This sweepstakes (the "Sweepstakes") is subject to all applicable laws and regulations. Void where prohibited or restricted by law. Sponsor: The Sweepstakes is provided by Boltnet Inc. ("Boltnet") 549 Howard Street, #400, San Francisco, CA 94105 (the "Sponsor"). The Boltnet web site ("Site") is provided by Boltnet. Sweepstakes Period: The Sweepstakes begins on October 14, 2011 at 12:00 p.m. Pacific Time ("ET") and ends November 17, 2011 at 11:59 p.m. PT. Sponsor's computer shall be the official timekeeper.
Contest Description
The "Public Everywhere and Anywhere" Contest is a competition help by BO.LT. The competition rewards two participants - one participant who has the most creative entry and one participant that has the most shared entry. The submissions must be created before 11:59pm on November 17th.
Here's What to Do
During the Promotion Period, visit http://bike.bo.lt/contest and follow the links and instructions to complete and submit the registration form. Once you submit the email or form, you will automatically receive a return email with the Internet address of your entry page. Your entry to the Contest should be shared via Twitter, Facebook or Google Plus. The more viral your submission is, the more likely you will win! The single entry with the greatest total number of Tweets, Facebook Likes or Google +1’s will win the first Public bike. We will periodically select a winner at random for a "daily drawing" prize. These prizes will be selected by BO.LT staff. A contestant can only win one "daily drawing," but can enter every day. Only one entry per day per contestant will be included in the daily drawing.
Prizes:
"Daily drawing" prizes may be awarded during the contest. These prizes are selected by the BO.LT staff and range in value. Winners of "daily drawing" prizes are also eligible for the bicycles and Better World Club Membership.
Two (2) PUBLIC bikes with Approximate Retail Value (ARV) of $550 will be awarded, plus $125 Ready to Ride bike assembly and shipping. Winners can choose between a PUBLIC C7 or PUBLIC V7 bike. The winners are responsible for all federal, state, and local taxes and fees associated with prize receipt and/or use. Prizes will be awarded "as is" with no warranty or guarantee, either express or implied offered by Sponsor. The winners can pick up their bike in San Francisco, or the bicycle can be shipped according to Public Bikes’ normal method within the continental United States.
Contest Prize Selection and Verification of Potential Winners:
All selected potential winners must comply with all terms and conditions of these Official Rules, and all winnings are contingent upon fulfilling all requirements. WInners are responsible for responding to BO.LT's email attempts in obtaining mailing information once the winner is confirmed.
The Contest and the selection of potential winners are final and binding in all matters related to the Contest. One of the prizes will be given away at sole discretion of the Sponsor, based on an evaluation of responses submitted by participants. The Sponsor will select all prize winners. The winner will be judged on the following criteria in the Sponsor's sole and unfettered discretion: Originality and creativity of Entrant's responses to the topics. The second prize will be determined by the submission with the most number of total "social shares". The total number of "social shares" is considered the sum of the number of people who "like" the entry on Facebook, the number of tweets of the submission on Twitter and the number of times the page is shared on Google Plus.
Prizes will be fulfilled approximately 8-10 weeks after the conclusion of the Contest.
Eligibility:
BO.LT's #ridePUBLIC (the "Contest") is open only to legal residents within the contiguous (48) United States and the District of Columbia who are at least eighteen (18) years old at the time of entry. Void where prohibited. Employees, officers, and representatives of PUBLIC and BO.LT, as well as the immediate family (spouse, parents, siblings, and children) and household members of each such employee are not eligible. The Contest is subject to all applicable federal, state, and local laws and regulations. Participation in the Contest constitutes entrant's full and unconditional agreement to these Official Rules and Sponsor's decisions, which are final and binding in all matters related to the Contest. Winning a prize is contingent upon fulfilling all requirements set forth herein.
Rules
Use of any automated system to participate or manual manipulation of statistics by employing "off-shore" or equivalent labor is prohibited and will result in disqualification. Participants are free to create multiple entries but only one prize will be awarded to one participant. Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible, or misdirected registrations, which will be disqualified. In the event of a dispute as to any registration, the authorized account holder of the email address used to register will be deemed to be the registrant or player. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider, Internet service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted address. Each potential winner may be required to show proof of being the authorized account holder.
In entering the contest, you agree that you will not do any of the following: violate or infringe the copyrights, rights of privacy or publicity, or any other rights of any person; post or submit libelous, defamatory, pornographic, obscene, harassing or otherwise actionable or objectionable material; use the Service to send unsolicited or unauthorized advertising or promotional material or any junk mail, spam or chain letters that may be in violation of any applicable laws, such as privacy or CAN-SPAM laws; use automated scripts, spiders, bots or similar means to harvest or collect member information or other information from the Site; however, you may capture contact data and other information where the Site expressly permits, encourages or requires it; use the Site in a manner that could damage, disable or overburden the Site or violate the law; provide inaccurate or misleading information when registering as a member; impersonate or misrepresent your affiliation with any person or entity; or upload or transmit software viruses, worms, Trojan horses or other computer code or files designed to disable, destroy or interfere with any software or equipment. The above list of prohibitions provides examples and is not complete or exclusive. These prohibitions do not require BO.LT to monitor, police or remove any Submissions, Coding Changes or Content Changes submitted or loaded to the Service by you or any other user, and BO.LT disclaims any obligation or responsibility to do so.
Copyright Infringement
It is Boltnet’s policy to respond promptly to claims of copyright infringement and to remove or block access to any infringing material as described below. If you believe that any content or pages served by the BO.LT network contains infringing material or property, then please notify us as soon as possible. ALL POTENTIAL ENTRIES ARE SUBJECT TO VERIFICATION BY SPONSOR, WHOSE DECISIONS ARE FINAL AND BINDING. AN ENTRANT IS NOT A WINNER OF ANY PRIZE, EVEN IF THE CONTEST SHOULD SO INDICATE, UNLESS AND UNTIL ENTRANT'S ELIGIBILITY HAS BEEN VERIFIED AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE.
Publicity:
Except where prohibited, participation in the Contest constitutes each winner's consent to Sponsor's use of winner's name, likeness, photograph, voice, opinions, biographical information, hometown, and state for promotional purposes in any media without further payment or consideration.
General Conditions:
Sponsor reserves the right to cancel or modify the Contest if fraud, technical failures, or any other factor beyond Sponsor's reasonable control impairs the integrity of the Contest, as determined by Sponsor in its sole discretion. Any attempt by any person to deliberately damage any web site or undermine the legitimate operation of the Contest is a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
Release:
IN NO EVENT WILL THE SPONSOR OR ANY SWEEPSTAKES ENTITIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF ENTRANT'S PARTICIPATION IN THE SWEEPSTAKES OR ANY PRIZE WON OR ENTRANT'S ACCESS TO OR USE OF ANY OF SPONSOR'S WEBSITE, OR THE ACCESSING, DOWNLOADING AND/OR PRINTING OF ANY MATERIAL AVAILABLE ON SAID SITES. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON SPONSOR'S WEB SITE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSIONS OF IMPLIED WARRANTIES SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY.
Limitations of Liability:
The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Contest; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines, or network hardware, or software; (3) unauthorized human intervention in any part of the entry process or the Contest; (4) technical or human error which may occur in the administration of the Contest or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Contest, or receipt, or use of any prize or while traveling to or from any prize-related activity.
If, for any reason, the Sweepstakes is not capable of running as planned because of circumstances including, but not limited to, unauthorized intervention, fraud, technical failures, or any other causes, which in Sponsor's sole judgment corrupts or affects the administration, security, fairness, integrity or proper conduct of this Sweepstakes, Sponsor reserves the right, in its sole discretion and determination of fairness, to cancel, terminate, modify or suspend the Sweepstakes and to select the winners from entries received prior to such action. Sponsor may disqualify any entrant suspected of tampering with the entry process, operation of the Sweepstakes, the operation of the website, or violates these official rules. Use of bots or other automated process to enter is prohibited and may result in disqualification at the sole discretion of the Sponsors. Sponsors are not responsible for errors in the administration or fulfillment of these sweepstakes, including without limitation mechanical, human, printing, distribution, or production errors, and may modify or cancel a sweepstakes based upon such an error at their sole discretion, and without liability.
By registering to enter the Sweepstakes, each entrant acknowledges he/she has read, understands and will abide by these official rules. All issues and questions concerning the construction, validity, interpretation and enforceability of these official rules, or the rights and obligations of entrants and/or Sponsor in connection with the Sweepstakes, shall be governed by and construed in accordance with, the laws of the State of California.
Disputes:
Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Northern District of California (Southern Division) or the appropriate California State Court located in the City and County of San Francisco, California; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys' fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of California without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California.
Winner List: For the names of the winner, send a self-addressed stamped envelope for receipt by October 1, 2011, to: BO.LT "Public Everywhere and Anywhere." Sweepstakes, 594 Howard Street #400, San Francisco, CA 94105.
The personal information collected from each entrant in the course of the Sweepstakes will be used by Boltnet for the purposes of administration of the Sweepstakes and as otherwise permitted in accordance with Boltnet’s Privacy Policy.
